Pandemic Policies & Practices: A Conversation on Legal Liability, Immunity & Retaliation (MAR-PHTC)

Crisis standards of care, the possibility of rationing scarce resources, and constraints placed on care activities usually provided as standards of care have raised concerns about the potential liability of healthcare providers working during this pandemic. Healthcare workers, in turn, have called for immunity from civil and criminal liability when they act in good faith, and according to available guidelines, in crisis circumstances. Further, some healthcare workers who have spoken out to the media about the lack of Personal Protective Equipment (PPE) have been threatened with retaliation by their employers.

  • Can they sue institutions for this actual or threatened retaliation?
  • Could institutions be liable to their employees (for negligence if their employees acquire COVID-19 because of a failure to provide the PPE) or to patients who believe they acquired the virus because their caregivers lacked PPE?

The Mid-Atlantic Regional Public Health Training Center (MAR-PHTC) is pleased to offer the second session in our Pandemic Policies and Practices distance-accessible series, hosting discussions of relevant and thought-provoking ethical and legal issues surrounding the COVID-19 pandemic. Join Diane Hoffman, JD of the University of Maryland and Elizabeth Van Nostrand, JD of the University of Pittsburgh as they discuss these questions and how relevant laws differ across jurisdictions.

This training program for public health and clinical professionals, attorneys, researchers, students, and others interested in learning more about COVID-19 was presented by the Mid-Atlantic Regional Public Health Training Center (MAR-PHTC) in coordination with the Allegheny County Bar Association. Funded by the Health Resources and Services Administration and based at the University of Pittsburgh's Graduate School of Public Health, the Mid-Atlantic Regional Public Health Training Center (MAR-PHTC) is a partnership among schools of public health, academic institutions, and public health agencies and organizations working to strengthen the capabilities of the public health workforce to support the delivery of high-quality public health services throughout the Mid-Atlantic region.

How to Register: Log on to marphtc.pitt.edu and sign in with your username and password. Find and select Science and Law: Navigating Through COVID-19 and click the "Enroll" button under Course Registration at the bottom of the page. After you are successfully enrolled, you will receive an email confirmation that contains important information about this course.
